1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Business Cheetah (“we”, “our”, or “us”), a company registered in the United Kingdom.

By accessing or using our AI-powered business advisory platform, making phone calls to our AI agents, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Please also review our Privacy Policy, which describes how we collect and use your information.

2. Description of Service

Business Cheetah provides an AI-powered business advisory platform accessible via our mobile applications (iOS and Android) and web application. The platform includes:

  • A team of specialised AI agents for different business functions (strategy, operations, finance, culture, and more)
  • Text and voice meetings with AI team members
  • AI phone calls for business advisory
  • Business document and code generation
  • Investor outreach, campaign management, and investor room tools
  • Multi-company support — switch between companies from a single login
  • Company-level Ops wallets and team seat management
  • Portfolio-level dashboards for investors and holding groups

All AI operations consume Ops Units from your company's wallet. See Section 5 for details on pricing and Ops Units.

Important: Our AI agents provide general business guidance and suggestions. They are not a substitute for professional legal, financial, tax, or investment advice. Always consult qualified professionals for specific professional advice.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Be using the service for legitimate business purposes
  • Not be prohibited from using the service under applicable law
  • Provide accurate and complete registration information

4. Your Account

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use
  • Not share your account with others or create multiple accounts

We may suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in fraudulent or illegal activity.

5. Pricing and Payment

5.1 Ops Units

Our platform operates on a credit-based system called “Ops Units”. Every AI operation (text meetings, voice meetings, phone calls, document generation, etc.) consumes Ops Units. The number of units consumed per operation is fixed regardless of your plan; your plan determines the price per unit.

5.2 Plans

We offer the following plans. Companies subscribe to their own plan with their own Ops wallet. Users draw from their company's allocation.

  • Pay As You Go (PAYG): No commitment. 25 free Ops Units on signup. Top up at the standard per-unit rate anytime.
  • Starter: Monthly subscription with included Ops Units and a discounted per-unit rate for additional usage.
  • Pro: Monthly subscription with a larger Ops Unit allocation, multiple seats, and a further discounted per-unit rate.
  • Portfolio: Monthly subscription for investors, holding groups, and multi-entity operators providing consolidated visibility across multiple companies. Companies connected to a Portfolio account must have their own active subscriptions.

Current pricing and included allocations are displayed on our Pricing page. Prices are in US Dollars (USD). Local currency billing may be available.

5.3 Free Ops Units

New users on the Pay As You Go plan receive a one-time allocation of 25 free Ops Units upon signup. These units are non-transferable, have no cash value, and are provided to allow you to explore the platform. No payment information is required to receive the free units.

5.4 Billing and Auto Top-Up

Subscription fees are billed in advance on a monthly or annual basis. Payment is processed securely through Stripe. By subscribing, you authorise us to charge your payment method automatically at each billing interval. You may enable auto top-up, which automatically adds Ops Units to your wallet at your plan's rate when your balance falls below a threshold you set.

5.5 Unused Ops Units

Included Ops Units refresh each billing period and do not roll over to the next period. Topped-up (purchased) Ops Units remain in your wallet until used and do not expire.

5.6 Price Changes

We reserve the right to change our prices. We will give you at least 30 days' notice of any price increase. Continued use after a price change constitutes acceptance of the new price.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time by:

  • Using the cancellation option in your account settings (if available)

Cancellation takes effect at the end of your current billing period. You will retain access to your remaining Ops Units and subscription features until then.

6.2 Downgrading

You may upgrade or downgrade your plan at any time. Downgrades take effect at the start of your next billing period. If you downgrade to Pay As You Go, any remaining included Ops Units from your previous plan will not carry over.

6.3 Refund Policy

  • Subscriptions: We do not offer refunds for partial billing periods. If you cancel, you retain access until the end of your paid period.
  • Ops Unit Top-Ups: Purchased (topped-up) Ops Units are non-refundable once added to your wallet.
  • Consumer Rights: UK consumers may have additional statutory rights under the Consumer Rights Act 2015. Contact us if you believe you are entitled to a refund.

7. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the service
  • Use automated tools to scrape or extract data
  • Resell, redistribute, or commercially exploit our services without permission
  • Impersonate others or provide false information
  • Use the AI agents for purposes unrelated to business advisory
  • Attempt to manipulate or abuse the AI systems

8. Intellectual Property

8.1 Our Property

The Business Cheetah platform, including its software, AI models, design, logos, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Your Content

You retain ownership of the content you provide (business information, documents, etc.). By using our service, you grant us a licence to use this content to provide and improve our services.

8.3 Generated Content

Deliverables generated by our AI (roadmaps, pitch decks, etc.) based on your input are yours to use. However, we retain rights to the underlying AI systems and methodologies.

9. AI-Generated Content & Limitations

Our service relies heavily on artificial intelligence. By using Business Cheetah, you acknowledge and agree to the following:

  • AI Nature: All advisors, team members, and agents within the platform are AI-powered. They are not real people. Interactions are generated by large language models.
  • Accuracy: AI-generated content, advice, documents, strategies, and recommendations may contain errors, inaccuracies, or omissions. You should independently verify any information before acting on it.
  • Not Professional Advice: Nothing generated by our AI constitutes professional legal, financial, tax, investment, medical, or any other form of regulated professional advice. Always consult qualified human professionals for critical decisions.
  • No Guarantee of Outcomes: We do not guarantee that following AI-generated strategies or advice will lead to any specific business outcomes, revenue, growth, or success.
  • Content Ownership: AI-generated deliverables (pitch decks, roadmaps, documents, etc.) are provided for your use, but the underlying AI models and methodologies remain our property.
  • Data Usage: Your conversations and business information are used to personalise AI responses. See our Privacy Policy for details on how your data is handled.
  • Continuous Improvement: AI models may be updated or changed, which may affect the nature of responses over time.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Specifically, we do not warrant that:

  • The service will be uninterrupted or error-free
  • The AI advice will be accurate, complete, or suitable for your specific situation
  • The service will meet your specific requirements
  • Any defects will be corrected

AI Limitations: Our AI agents are sophisticated but not infallible. They may occasionally provide incorrect, incomplete, or inappropriate suggestions. Always use your own judgment and seek professional advice for critical business decisions.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any business losses, loss of profits, revenue, data, or business opportunity

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Business Cheetah, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you provide to the service

13. Termination

We may suspend or terminate your access to the service at any time if:

  • You breach these Terms
  • We are required to do so by law
  • We decide to discontinue the service (with reasonable notice)
  • Your payment fails and remains unpaid

Upon termination, your right to use the service ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless you are a consumer in another jurisdiction entitled to bring proceedings in your local courts.

Dispute Resolution: Before initiating legal proceedings, we encourage you to contact us to resolve any issues. Many disputes can be resolved quickly through direct communication.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the “Last updated” date
  • Sending you an email notification for significant changes

Continued use of the service after changes constitutes acceptance of the new Terms.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right does not waive that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor or acquirer.
  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
